Welcome to TripInStays. These Terms & Conditions (“Terms”) govern your access to and use of our website, applications, and services (the “Platform”). Please read them carefully. By using the Platform, you agree to be bound by these Terms and our Privacy Policy.
1. About the Platform
TripInStays is a vacation property lead-generation marketplace. We list properties submitted by owners and enable guests to discover stays and request verified owner contact details. TripInStays does not act as the host, agent, or booking party for guest stays unless explicitly stated in writing for a specific promotional programme.
2. Eligibility
You must be at least 18 years old and capable of entering a binding contract under Indian law. By registering, you represent that information you provide is accurate and current.
3. Account Registration
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately of unauthorised account use.
- We may suspend or terminate accounts that violate these Terms or applicable law.
- One person may not maintain multiple guest accounts to abuse OTP or enquiry limits.
4. Guest Use
4.1 Browsing & enquiries
You may search listings, save properties, compare stays, and submit enquiries. Listing information (photos, prices, amenities) is provided by owners and may change without notice. Displayed prices are indicative unless confirmed directly with the owner.
4.2 OTP contact unlock
- Owner contact is shared only after successful OTP verification on the mobile number you provide.
- You agree to use owner contact details solely for legitimate stay enquiries related to the property requested.
- Spam, harassment, resale of leads, or automated scraping of owner data is prohibited.
- OTP attempts are rate-limited; misuse may result in permanent suspension.
4.3 Direct dealings with owners
Any booking, payment, check-in, house rules, security deposit, or stay experience is strictly between you and the property owner. TripInStays is not a party to that agreement and is not responsible for owner conduct, property condition, or disputes arising from your stay.
5. Owner & Partner Use
- Owners must have lawful authority to list and offer the property for short-term stays.
- Listings must be accurate, non-misleading, and comply with local laws, society bylaws, and tax requirements.
- Owners must respond to verified enquiries in good faith and honour communicated cancellation/refund policies.
- Premium, featured, or curated placement may require a paid subscription; fees are non-refundable except as stated at purchase or required by law.
- We may edit, reject, suspend, or remove listings that violate policies or receive credible complaints.
6. Prohibited Conduct
You may not:
- Post false, defamatory, discriminatory, or illegal content.
- Impersonate another person or misrepresent affiliation with TripInStays.
- Interfere with Platform security, reverse engineer software, or use bots without permission.
- Circumvent OTP, enquiry, or subscription systems.
- Use the Platform for money laundering, fraud, or unlawful short-term letting where prohibited.
7. Intellectual Property
TripInStays name, logo, design, software, and compiled content are owned by us or our licensors. Owners grant us a non-exclusive licence to display listing content for marketing the Platform. You may not copy, modify, or distribute Platform materials without written consent.
8. Reviews
Guests may submit reviews after a stay experience. Reviews must be honest and based on genuine experiences. We may moderate or remove reviews that are abusive, incentivised, or clearly false.
9. Payments
Guest payments for accommodation are made directly to owners unless we explicitly offer a separate payment product. Owner subscription payments are processed through third-party gateways; their terms also apply. TripInStays is not liable for gateway downtime or chargeback disputes between owners and payment providers.
10. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THE ACCURACY OF LISTINGS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIPINSTAYS AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM OR ANY INTERACTION WITH OWNERS OR GUESTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) INR 5,000 OR (B) THE AMOUNT YOU PAID TO TRIPINSTAYS IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless TripInStays from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your listings, your stay, or your breach of these Terms.
13. Termination
We may suspend or terminate access at any time for violation of these Terms or for operational reasons. Provisions that by nature should survive (liability limits, indemnity, governing law) will survive termination.
14. Governing Law & Disputes
These Terms are governed by the laws of India. Courts at Mumbai, Maharashtra shall have exclusive jurisdiction, subject to applicable consumer protection laws that may provide you additional rights in your place of residence.
15. Changes
We may modify these Terms by posting an updated version on the Platform. Material changes will be indicated by updating the “Last updated” date. Continued use constitutes acceptance.
